In no event shall winjili's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to winjili in the six (6) months prior to the claim, or One Thousand Philippine Pesos (PHP 1,000), whichever is greater.
You agree to defend, indemnify, and hold harmless winjili and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including without limitation any copyright, property, or privacy right; or (d) any claim that your use of the Service caused damage to a third party.
winjili reserves the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, for any reason including but not limited to: (a) violation of these Terms; (b) suspected fraudulent, abusive, or illegal activity; (c) prolonged inactivity; or (d) at your request. Upon termination, your right to use the Service will immediately cease. If your account is terminated for cause, you may forfeit any remaining account balance, pending winnings, and bonus funds. winjili is not liable to you or any third party for any termination of your account or access to the Service.
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Service shall be resolved through good faith negotiations between you and winjili. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. The arbitration shall be conducted in Metro Manila, Philippines, and the language of the arbitration shall be English. The decision of the arbitrator shall be final and binding on both parties.
